I understand that Virginia Theatrical Society, Inc. DBA Bugatti’s (“The Club”) is a Virginia nonprofit corporation operating as a private membership organization under Section 501(c)(7) of the Internal Revenue Code. Access to the Club premises, events, and services is limited to approved members and their authorized guests in accordance with the Club’s bylaws and policies. Membership may be denied, suspended, or revoked at the discretion of the Club in accordance with its governing documents and applicable Virginia law. 2. Eligibility
I represent and warrant that: I am at least 21 years of age. I am legally permitted to consume alcohol in the Commonwealth of Virginia. All information provided in my membership application is true and accurate. Providing false information may result in termination of membership. 3. Compliance With Virginia Law
I agree to comply with: All applicable laws of the Commonwealth of Virginia Virginia ABC regulations All posted Club rules and staff instructions The Club reserves the right to refuse service consistent with Virginia law. LIABILITY & RISK PROVISIONS (Virginia-Specific Drafting) 4. Assumption of Risk
I understand that entering and participating in activities at the Club involves inherent risks, including but not limited to: Slips, trips, and falls Accidental contact in crowded areas Alcohol-related impairment Actions of other members or guests I voluntarily and knowingly assume all risks associated with my presence at the Club premises. 5. Release of Liability (Ordinary Negligence)
To the fullest extent permitted under Virginia law, I hereby release, waive, and discharge The Club, its directors, officers, members, managers, employees, contractors, and agents from liability for any claims arising out of personal injury, property damage, or loss occurring on the premises or at Club-sponsored events that result from ordinary negligence. This release does NOT apply to gross negligence or willful misconduct as defined under Virginia law. 6. Alcohol Responsibility Acknowledgment
I acknowledge: Alcohol impairs coordination and judgment. I am solely responsible for my decision to consume alcohol. I will not operate a motor vehicle while impaired. The Club may refuse alcohol service at its discretion. I accept full responsibility for my conduct while on the premises. 7. Indemnification
I agree to indemnify and hold harmless The Club from any claims, damages, or expenses arising from: My conduct My violation of law Injury or damage I cause to another person Damage to Club property 8. Personal Property
The Club is not responsible for lost, stolen, or damaged personal property. 9. Media Release
I grant permission for photographs or video taken on Club premises to be used for promotional purposes unless I provide written notice opting out. 10. Governing Law
This Agreement shall be governed by the laws of the Commonwealth of Virginia. Any disputes shall be brought in a court of competent jurisdiction located in Norfolk, Virginia. 11. Electronic Signature
By electronically signing, I acknowledge that: I have read and understand this Agreement. I voluntarily agree to its terms. My electronic signature is legally binding under the Virginia Uniform Electronic Transactions Act.
